What workers' compensation benefits are you entitled to?

Workers' compensation is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment in exchange for mandatory relinquishment of the employee's right to sue their employer for the tort of negligence in court. This is paid for by the employer and subject to no deductible by the employee.

In Georgia, Workers’ Compensation provision is made for weekly payments in place of wages called Temporary Total or Temporary Partial benefits, reimbursement or payment of medical treatment and included expenses like mileage and parking, as well as  payment for reduction in permanent use of the injured body part called Permanent Partial Disability. Benefits can also be payable to the dependents of workers killed during employment.

As a result of this system, general damages that you hear of, such as pain and suffering, and punitive damages, are not available in workers’ compensation actions.
