Georgia's open container law, OCGA Section 40-6-253(b) prohibits driving with an alcohol beverage in your car that has been opened. Under this law, both the consumption and possession of an open alcoholic beverage are prohibited. You may also be arrested for having an open container in the passenger area of the vehicle or in an unlocked glove compartment. Depending on your age, this violation can be just  a citation or a misdemeanor. 

There are several defenses to this charge. Considerations include the location of the container, how many people were in the car and probable cause for the stop.
