Independent Medical Examination (IME): Claimant's rights

second opinion?

Georgia workers’ compensation allows the insurance company to schedule evaluations for you with a doctor that they choose.  You must attend this appointment. The insurance company should be able to get an updated opinion about your medical treatment, as long as they agree to pay for it.  However, the insurance company’s right to a second opinion does have limits. 1. The appointment is for an examination only and the insurer can’t make you treat with that doctor. 2. The insurance company has to send you a check ahead of time for your mileage to the exam. 3. The examination must be at a reasonable place and time.

If  you get a bad report from the doctor the insurance company picks, an experienced workers' compensation specialist  can help you arrange your own examination with a good doctor to get another opinion about your injuries. Also, If the insurance company denies additional medical treatment based on a report from the doctor the insurance company picked, an attorney can request a hearing to get the medical treatment you need approved.
